Ventura County Board of Supervisors Sent Letter of Demand on Behalf of Pastor and Rabbi to Immediately Rescind  County Health Officer’s Order - Prohibits Churches and Synagogues from Drive-In and Other Essential Religious Services  

Ventura County, CA, April 16, 2020 – A letter of demand from Tyler Law LLP on behalf of their clients, Christian Pastor Rob McCoy and Jewish Rabbi Michael Barclay, was sent to the Ventura County Board of Supervisors and the Health Officer to act to revise the County Health Officer’s “Stay Well at Home” Order by the end of business on April 18, 2020.  The full demand letter is linked HERE.

Based on the County’s April 9, 2020 Order, numerous nonessential businesses find themselves deemed essential and religious organizations are generally deemed nonessential. This reflects upon the arbitrary nature of determining what businesses are “essential.”

Tyler Law LLP and their clients acknowledge the significant efforts made by the Ventura County Health Officer to protect the health and safety of the residents in Ventura County.  Their desire to be good citizens and their concerns over the coronavirus, however, have also left these religious leaders with serious concerns about preserving their fundamental liberties enshrined in the U.S. and State Constitutions.

Both Pastor and Rabbi are convinced that “we the people” are ultimately responsible to protect the individual liberties that may be lost unnecessarily during times of crisis regardless of whether public officials’ actions are well intentioned.  They struggle with finding the right balance of public safety and individual liberty considering the coronavirus. It is for these reasons that Tyler Law LLP is representing the public’s interest in preserving individual liberties and serving as a counterbalance to unchecked regulatory action.

In order to restore this balance, Tyler Law LLP is preparing the necessary paperwork to file a lawsuit to permit Pastor McCoy to hold drive-in church services on Sundays and communion services once a month all in compliance with CDC and County guidelines as is required of “essential businesses.”

The suit will also seek to permit Rabbi Barclay to hold weekly Torah services, periodic Bar Mitzvahs, and Shiva Minyans in compliance with CDC and County guidelines as is required of “essential businesses.”
